EzLicence Instructor Academy Referral Fee Program Terms and Condition

This referral program is made by EZ LICENCE PTY LTD (ABN 43 612 095 968) (EzLicence) and applies to the EzLicence Instructor Academy. Participation constitutes acceptance of these terms and EzLicence’s applicable policies.

The program applies only to enrolments in the Certificate IV in Motor Vehicle Driver Training Standard Package and excludes upgrade courses, limited practical courses, or any other course unless expressly stated by EzLicence.

For the purposes of these terms, “Referrer” means the person submitting the referral, “Referee” means the individual being referred to the EzLicence Instructor Academy, and “Qualifying Payment” means the successful enrolment in an eligible course together with payment in full, or entry into an approved payment arrangement and payment of any required initial instalment, as determined by EzLicence.

A referral fee is payable to an eligible referrer for each referred student who satisfies all eligibility requirements. To qualify, the referred student must not have previously been referred by another party or previously contacted, enquired with, engaged with EzLicence marketing and/or sales outreach, or commenced an application or enrolment process with the EzLicence Instructor Academy, must be referred in the manner specified by EzLicence, must enrol in an eligible course within 30 days of referral, must meet all applicable state and regulatory eligibility requirements, and must successfully enrol and make payment in full or enter into an approved payment arrangement and make any required initial payment as determined by EzLicence.

A referral will only be recognised where the referee expressly identifies the referrer by name at the time of initial enquiry or before the point of enrolment, either via the contact form on the EzLicence Instructor Academy page (https://www.ezlicence.com.au/instructor-academy) or during first communication with an EzLicence Instructor Academy representative.

Referral fees are payable only once per eligible referred student and only after EzLicence verifies successful enrolment and qualifying payment. Referral fees are inclusive of GST where applicable, personal to the referrer, non transferable, non assignable and not redeemable for any other benefit. The referral discount cannot be combined with any other promotional offer, discount, rebate or incentive unless expressly approved in writing by EzLicence.

A referral fee will not be payable where the referral is duplicate, invalid, misleading or fraudulent, where the student was previously referred or already in contact with the Academy, where the student fails to enrol within 30 days, fails to meet eligibility requirements, withdraws, cancels or receives a refund, or where EzLicence declines enrolment for any reason. EzLicence’s internal records are conclusive in determining referral validity and eligibility in the absence of manifest error.

Referral fees will be paid within 30 business days after EzLicence confirms the Referee’s successful enrolment and Qualifying Payment. Where the Referrer is an active EzLicence instructor with a payout account, the referral fee will be paid via the Referrer’s nominated instructor payout method in accordance with the payout frequency selected by the Referrer. Where the Referrer is not an active EzLicence instructor with a payout account, payment will be made via bank transfer to a bank account nominated by the Referrer. Referrers are solely responsible for any tax obligations arising from receipt of a referral fee and EzLicence will not withhold or remit taxes unless required by law.

EzLicence may verify identity and compliance with these terms and may withhold or refuse payment in cases of ineligibility, breach of applicable terms or policies, or suspected fraud or misconduct.

This referral program may be amended, suspended, withdrawn or replaced at any time at EzLicence’s discretion, and the applicable referral fee amount, eligibility criteria and conditions will be those in effect at the time the referred student enrols. Changes will not affect referral fees that have already been earned in accordance with the terms in effect at the time of enrolment.

Referrers must not refer themselves, related entities, employees, family members or any person for whom the referrer receives direct or indirect financial benefit from enrolment. EzLicence may withhold or recover referral fees where it reasonably suspects artificial, coordinated or non-arm’s length referrals.

EzLicence may limit the number of eligible referral fees payable to any single referrer to a maximum of ten (10) successful referred enrolments per calendar month under this program. Referrals in excess of this limit may, at EzLicence’s discretion, be deemed ineligible for payment unless otherwise agreed in writing. Referrers who anticipate referring volumes in excess of this cap on an ongoing basis are encouraged to contact EzLicence to discuss a separate commercial arrangement or volume-based referral agreement.

Nothing in these terms excludes, restricts or modifies any rights that cannot be excluded under the Australian Consumer Law or other applicable laws. To the extent permitted by law, EzLicence’s liability in connection with this program is limited to payment of the applicable referral fee.
